1. Introduction

Welcome to AfriHLTD Hub, an online freelance marketplace and digital services platform that connects clients and freelancers.
These Terms and Conditions (“Terms”) govern your access to and use of:

  • The AfriHLTD Hub website (hltd.shop)

  • The AfriHLTD Hub PWA (Progressive Web App)

  • All related products, tools, APIs, and services

By using our platform, you agree to these Terms.

If you do not agree, you must stop using AfriHLTD Hub immediately.

2. Definitions

  • “Platform” – the AfriHLTD Hub website, PWA, services, and systems.

  • “User” – any person using the Platform (Client or Freelancer).

  • “Client/Customer” – a user posting jobs or purchasing services.

  • “Freelancer/Service Provider” – a user offering skills or services.

  • “Project/Order” – a job posted by a Client or service purchased.

  • “Wallet” – a digital balance stored within the Platform.

  • “Escrow” – funds held until work is delivered or a dispute is settled.

3. Eligibility

To use the Platform, you must:

  • Be at least 18 years old

  • Provide accurate information

  • Have legal capacity to enter a contract

  • Not be banned from receiving online payments

AfriHLTD Hub reserves the right to deny or suspend access at any time.

4. User Accounts

To use the Platform, users must create an account and agree to:

  • Keep login details confidential

  • Not share accounts

  • Ensure information is accurate and updated

  • Immediately report unauthorized access

We may suspend or terminate accounts that violate these Terms.

5. Freelancers – Responsibilities

Freelancers must:

  • Deliver work on time

  • Provide original content

  • Not resell stolen or copyrighted materials

  • Maintain professional communication

  • Update project progress

  • Only accept jobs they can complete

Failure to deliver may result in refunds, penalties, or account termination.

6. Clients – Responsibilities

Clients must:

  • Provide clear requirements

  • Release payment upon successful delivery

  • Not harass or abuse freelancers

  • Not request free work

  • Not demand work outside the Platform to avoid fees (“off-platform work”)

Violation can lead to suspension or legal action.

7. Payments, Fees & Charges

AfriHLTD Hub may charge:

  • Service fees

  • Transaction fees

  • Withdrawal/payout fees

  • Currency conversion fees

All fees are displayed before checkout.

Funds may be held in escrow until the project is approved by the Client.

8. Payouts & Withdrawals (Freelancers)

Freelancers may withdraw funds to:

  • M-Pesa

  • Bank accounts

  • Supported payment methods on the Platform

Withdrawal processing times vary based on method.

AfriHLTD Hub is not responsible for delays caused by payment providers.

9. Refunds

Refunds may be issued if:

  • The freelancer fails to deliver

  • The work is not as described

  • A dispute resolves in favor of the Client

  • The Project violates Platform policy

Refunds are not issued for:

  • Change of mind

  • Work already approved

  • Work downloaded or used by the Client

10. Dispute Resolution

If a disagreement arises:

  1. The Client and Freelancer must try to resolve it.

  2. If unresolved, either party may open a dispute.

  3. AfriHLTD Hub will review communication and submissions.

  4. The final decision is made by AfriHLTD Hub moderators.

The decision is final and binding.

11. Prohibited Activities

Users must NOT:

  • Post illegal or harmful content

  • Engage in fraud or scams

  • Harass or bully others

  • Submit false identity documents

  • Circumvent payments

  • Upload viruses or harmful scripts

  • Use bots or automated systems

  • Copy, scrape, or resell Platform content

Violations may result in:

  • Account termination

  • Payout holds

  • Legal action

12. PWA (Progressive Web App) Usage

By installing the AfriHLTD Hub PWA, you agree that:

  • The app may store local offline data

  • Notifications (push alerts) may be sent

  • Cache may be stored for performance

  • The app may request permissions such as camera access for verification or uploads

You may disable permissions at any time.

13. Intellectual Property

  • All Platform content (design, code, branding, logos) belongs to AfriHLTD Hub.

  • Freelancers own rights to their original content until delivered.

  • After payment, ownership transfers to the Client unless stated otherwise.

Users may not copy, modify, or distribute Platform content.

14. Data Protection & Privacy

We collect user data to:

  • Verify identity

  • Prevent fraud

  • Process transactions

  • Improve service delivery

  • Provide customer support

Your data is handled under our Privacy Policy, aligned with:

  • Kenya Data Protection Act, 2019

  • International privacy standards (GDPR-friendly)

15. Cookies

AfriHLTD Hub uses cookies for:

  • User sessions

  • Login security

  • Analytics

  • Personalization

  • PWA caching

You may disable cookies in your browser, but some features may not work.

16. Termination

We may suspend or terminate accounts for:

  • Repeated violations

  • Fraud

  • Abuse

  • Chargebacks

  • Security risks

  • Illegal activity

Users may close accounts anytime by contacting [email protected].

17. Limitation of Liability

AfriHLTD Hub is not liable for:

  • Loss of profits

  • Payment provider delays

  • Freelancer errors

  • Client misuse

  • Third-party service failures

  • Loss of data caused by the user

We provide the Platform “as-is” without warranties.

18. Changes to These Terms

We may update these Terms at any time.
Continued use of the Platform means you accept the updates.

19. Governing Law

These Terms are governed by the laws of:

Republic of Kenya

Any legal proceedings shall be handled within Kenyan jurisdiction.
